Terms of service
1. About These Terms
These Terms of Service apply when you access the QUIVE London website or purchase products from us.
Please read these terms carefully before placing an order. By placing an order through our website, you agree to be bound by these terms together with our:
- Return and Refund Policy
- Shipping Policy
- Privacy Policy
- One Year Warranty
- Any additional terms displayed during checkout
Nothing in these terms limits or excludes your statutory rights as a consumer.
2. About Us
QUIVE London is a trading name of SEGA International Limited.
Our business and contact details are provided in the Contact Information section of our website and on our Contact Us page.
References in these terms to “QUIVE London”, “we”, “us” or “our” mean SEGA International Limited.
References to “you” or “your” mean the person using our website or placing an order.
3. Eligibility to Order
You must be at least 18 years old and legally capable of entering into a binding contract to place an order through our website.
By placing an order, you confirm that:
- The information you provide is accurate and complete
- You are authorised to use the selected payment method
- You are purchasing for lawful purposes
- You agree to comply with these terms
We may refuse or cancel an order where we reasonably believe that an order is fraudulent, unauthorised, unlawful or made in breach of these terms.
4. Product Information
We take reasonable care to ensure that product descriptions, images, prices, materials, measurements and other information displayed on our website are accurate.
However:
- Colours may appear slightly different depending on your screen or device
- Product measurements may vary slightly
- Natural leather and suede may display variations in grain, texture, shade or appearance
- Packaging may occasionally differ from that shown
- Minor product improvements may be made without materially changing the product
Natural variations do not automatically indicate a defect. This does not affect your rights where a product is faulty, damaged, not as described or otherwise fails to meet legal requirements.
Material specifications provided on each individual product page should be reviewed before ordering.
5. Prices
Prices are displayed in pounds sterling and include VAT where applicable.
Delivery charges, where applicable, will be displayed before you complete your order.
We may change prices at any time, but changes will not affect an order that we have already accepted.
If a product has been listed at an incorrect price because of an obvious error, we may contact you before accepting the order. You may then confirm the order at the correct price or cancel it for a full refund.
Promotional offers, discount codes and sale prices may be subject to additional conditions and availability.
6. Placing an Order
You can review and correct your order before submitting payment.
When you place an order, you are making an offer to purchase the selected products.
After receiving your order, we will normally send an electronic acknowledgement. This confirms that we have received your order but does not necessarily mean that we have accepted it.
A binding contract is formed when we send confirmation that the order has been dispatched, unless we expressly confirm acceptance at an earlier stage.
Each dispatched order will form a separate contract between you and us.
7. Order Acceptance and Cancellation by Us
We may be unable to accept an order for reasons including:
- The product is unavailable
- Payment could not be authorised
- We identified an error in the price or description
- Delivery is unavailable to the address provided
- Purchase limits apply
- We reasonably suspect fraud or misuse
- The order would breach applicable law
Where payment has already been taken for an order that we cannot accept, we will issue a refund to the original payment method.
We will not cancel an accepted order without a valid reason.
8. Product Availability
All products are subject to availability.
Placing an item in your basket does not reserve it.
Where an item becomes unavailable after an order is placed, we will contact you and provide an appropriate refund for the unavailable item.
We may limit the quantity of products that can be purchased in a single order where reasonably necessary.
9. Payment
Available payment methods are shown during checkout.
Payment must be authorised before an order can be processed or dispatched.
You confirm that:
- You are authorised to use the payment method
- The billing information provided is correct
- Sufficient funds or credit are available
Payments may be processed by third-party payment providers. Their own terms and privacy practices may also apply.
We do not normally store complete payment-card details on our own systems.
10. Delivery
Delivery options, charges and estimated times will be displayed during checkout or explained in our Shipping Policy.
Please provide a complete and accurate delivery address.
We aim to dispatch and deliver orders within the timeframes stated on our website. Delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control, including carrier delays, adverse weather, public holidays and incorrect address details.
Unless another timeframe has been agreed, goods will be delivered without undue delay and normally within 30 days after the contract is formed.
Further information about dispatch, delivery estimates, tracking and undeliverable orders is provided in our Shipping Policy.
11. Risk and Ownership
Responsibility for the goods passes to you when:
- The goods are delivered to you, or
- They are delivered to another person identified by you to receive them
Where you arrange your own independent carrier and that carrier was not offered by us, responsibility may pass when the goods are handed to that carrier, where permitted by law.
Ownership of the goods passes to you once we have received payment in full.
12. Inspecting Your Order
Please inspect your order after delivery.
Contact our Customer Care team promptly if:
- An item is missing
- You received the wrong product
- The parcel or product arrived damaged
- You believe the product is faulty
- The product is materially different from its description
Please provide your order number, a description of the issue and photographs where possible.
Reporting an issue promptly helps us investigate it, but it does not remove any statutory rights you may have.
13. Cancellations and Returns
Your rights to cancel an online order and return eligible products are explained in our Return and Refund Policy.
For eligible online purchases, consumers normally have the right to cancel within 14 days after delivery without giving a reason. QUIVE London also provides an extended 30-day return period for eligible products, subject to the conditions in our Return and Refund Policy.
Returned products must be handled and packaged in accordance with that policy.
Nothing in our returns policy affects your legal rights in relation to faulty, damaged or misdescribed goods.
14. Refunds
Approved refunds will be issued to the original payment method.
Refund processing times and the treatment of original delivery charges are explained in our Return and Refund Policy.
Your bank, card issuer or payment provider may require additional time to display a refund after it has been issued.
15. Faulty or Misdescribed Goods
Products supplied by us must meet the requirements of applicable UK consumer law.
Nothing in these terms excludes or restricts our responsibility for goods that are:
- Faulty
- Not of satisfactory quality
- Not fit for their normal or agreed purpose
- Not as described
- Supplied without the legal right to sell them
Depending on the circumstances, you may be entitled to a refund, repair, replacement or price reduction.
Your rights concerning faulty goods are separate from and additional to our commercial warranty.
16. One Year Warranty
Eligible QUIVE London footwear is covered by our One Year Warranty against manufacturing defects from the date of purchase.
The warranty does not normally cover:
- Normal wear and tear
- Accidental damage
- Misuse or neglect
- Improper care or storage
- Third-party alterations or repairs
- Natural variations in leather grain or appearance
Full terms, exclusions and claim instructions are provided on our One Year Warranty page.
The warranty is provided in addition to your statutory consumer rights and does not replace or restrict them.
17. Personal Use
Our products are supplied primarily for domestic and private use.
Unless expressly agreed otherwise, you must not purchase products for unauthorised resale, commercial distribution or fraudulent purposes.
We may restrict or refuse orders that appear to be made for unauthorised resale.
18. Promotions and Discount Codes
Promotions and discount codes:
- Are subject to availability
- May have expiry dates
- May apply only to selected products
- May require a minimum purchase
- May not be combined with other offers
- Must not be sold, copied or misused
We may withdraw or refuse a promotion where it has expired, been used improperly or was issued because of an obvious error.
Withdrawal of a promotion will not affect an order already accepted, except where fraud or misuse is involved.
19. Website Availability
We aim to keep our website available and accurate, but we do not guarantee uninterrupted access.
We may temporarily suspend, restrict or update parts of the website for maintenance, security, technical or operational reasons.
We are not responsible for failures caused by systems or networks outside our reasonable control, but this does not affect any responsibility that cannot legally be excluded.
20. Website Use
You must not:
- Use the website unlawfully or fraudulently
- Attempt to gain unauthorised access to our systems
- Introduce viruses, malicious software or harmful code
- Scrape or extract website content without permission
- Interfere with the website’s proper operation
- Use our branding or content in a misleading way
- Impersonate another person or provide false information
We may restrict access where reasonably necessary to protect our customers, business or systems.
21. Intellectual Property
The website and its content, including branding, logos, designs, text, photographs, graphics and software, are owned by or licensed to QUIVE London unless stated otherwise.
You may view and use the website for personal, non-commercial shopping purposes.
You must not reproduce, modify, distribute, sell, publish or commercially exploit our content without prior written permission.
“QUIVE London” and associated branding may not be used without authorisation.
22. Third-Party Services and Links
Our website may contain links to third-party websites or use services operated by payment providers, carriers, social networks or other suppliers.
We are not responsible for third-party websites that we do not control.
Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
23. Our Responsibility to You
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory consumer rights
- Faulty or misdescribed goods
- Any other liability that cannot legally be excluded
Where products are purchased wholly or mainly for business purposes, different legal rights may apply.
24. Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control.
These may include severe weather, carrier disruption, industrial action, public emergencies, failures of communication networks or government restrictions.
Where such an event affects an accepted order, we will take reasonable steps to reduce the delay and keep you informed.
Your legal cancellation and refund rights remain unaffected.
25. Personal Information
We process personal information in accordance with our Privacy Policy.
Please review that policy to understand how we collect, use, store and share personal information.
26. Changes to These Terms
We may update these terms to reflect changes in:
- Applicable law
- Our services
- Website functionality
- Payment or delivery arrangements
- Business operations
The terms applying to your order will normally be those displayed when the order was placed.
Changes will not remove rights relating to an order already accepted.
27. Severability
Each section of these terms operates separately.
If a court or competent authority decides that any provision is unlawful or unenforceable, the remaining provisions will continue to apply.
28. No Waiver
If we delay enforcing a right under these terms, that does not mean we have waived that right.
Any waiver must be clearly confirmed by us.
29. Third-Party Rights
Unless expressly stated otherwise, a person who is not a party to the contract does not have the right to enforce these terms.
30. Governing Law and Courts
These terms and contracts formed through our website are governed by the laws of England and Wales.
If you live in England or Wales, legal proceedings may be brought in the courts of England and Wales.
If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom where you live.
You retain any mandatory consumer protections provided by the law of your country of residence.
31. Contact Us
